What is Form W-9?

Form W-9 is how U.S. businesses collect your taxpayer identification number before paying you as an independent contractor. For expert witnesses, that means law firms, expert marketplaces, and consulting agencies will ask for one before releasing payment — they need it to file Form 1099-NEC for any year they pay you $600 or more. The form itself never goes to the IRS; it stays on file with the party paying you.

Frequently asked questions

What is Form W-9 used for?

Form W-9 (Request for Taxpayer Identification Number and Certification) gives the party paying you — a law firm, expert witness marketplace, or other business — the information they need to report those payments to the IRS on Form 1099. As an expert witness, you'll typically be asked for a W-9 before your first invoice is paid.

Do expert witnesses need to fill out a W-9?

Yes, in most cases. Expert witnesses are usually engaged as independent contractors, and any firm that pays you $600 or more in a year must file a 1099-NEC — which requires your W-9 on file. Providing it up front avoids payment delays and backup withholding.

Is this W-9 generator really free?

Yes. It fills the official IRS Form W-9 (Rev. March 2024) and generates a finished PDF at no cost, no account required.

Is it safe to enter my SSN here?

Your form is generated entirely inside your browser. Your SSN or EIN is never transmitted to our servers, never stored, and never seen by us. When you click Generate, your browser fills the IRS PDF locally and downloads it directly to your device.

Should I use my SSN or an EIN?

Sole proprietors may use either, though the IRS prefers the SSN on a W-9 for individuals. If you run your expert witness work through an LLC or corporation, use that entity's EIN and enter the entity's name as shown on your tax return.

Can I sign the W-9 electronically?

Yes. The tool can stamp a typed electronic signature and today's date into Part II, which most requesters accept. If your requester insists on a wet signature, generate the PDF unsigned, print it, and sign by hand.

This tool fills IRS Form W-9 (Rev. March 2024) as published at irs.gov. It is provided for convenience and is not tax advice — consult your tax professional about your classification and withholding status.
